These General Conditions of Sale, hereinafter the "CGV", govern sales concluded on the website https://azbeautyk.com/, hereinafter the "Site".

They are concluded between:

Hereinafter referred to as "AZ Beautyk" or "the Seller",

And any person making a purchase on the Site, hereinafter referred to as "the Customer".

Any order placed on the Site implies full, complete and unreserved acceptance of these General Terms and Conditions.

Article 1 - Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of AZ Beautyk and the Customer in the context of the online sale of products offered on the Site.

The Customer acknowledges having read these General Terms and Conditions before validating his order.

The applicable General Terms and Conditions are those in force on the day of the order.

Article 2 - Products

The products offered for sale are those presented on the Site AZ Beautyk, while stocks last.

AZ Beautyk takes the greatest care in the presentation of products, their descriptions and their photographs.

However, the photographs on the Site are provided for illustrative purposes. Slight differences may exist between the images displayed and the actual product, in particular due to lighting, screen settings, changes in supplier packaging or shooting conditions.

The essential characteristics of the products are indicated on each product sheet. The Customer is invited to consult them carefully before ordering.

Article 3 - Availability of products

Products are offered while stocks last.

In the event of exceptional unavailability of a product after validation of the order, AZ Beautyk will inform the Customer as soon as possible.

The Customer will then be able to choose between:

• refund of product unavailable;
• waiting for a restocking when possible;
• replacement with an equivalent product, only with the Customer's agreement.

In the event of a refund, this will be made via the payment method used when ordering, unless otherwise agreed between the parties.

Article 4 - Items specially ordered from suppliers

In order to best satisfy its customers, AZ Beautyk may order certain items specifically from its suppliers after validation of an order.

In this case, the Customer is informed that:

• the preparation time may be extended;
• the announced deadlines are given for information purposes only;
• cancellation of the order may no longer be possible once the supplier order has been initiated, except under legal law applicable to the Customer.

As these items are supplied especially for the order, AZ Beautyk invites the Customer to carefully check their order before validation.

This clause does not deprive the consumer Customer of his legal rights, in particular the right of withdrawal when this is applicable.

Article 5 - Price

Prices are indicated in euros.

AZ Beautyk being a micro-enterprise, VAT is not applicable in accordance with article 293 B of the General Tax Code.

The prices indicated do not include delivery costs, unless otherwise stated. Delivery costs are indicated to the Customer before final validation of the order.

AZ Beautyk reserves the right to modify its prices at any time. However, the products will be invoiced at the price displayed at the time of validation of the order.

In the event of a manifest price error, AZ Beautyk reserves the right to cancel the order and inform the Customer.

Article 6 - Order

The Customer places an order directly on the Site.

Before final validation, the Customer is invited to check the contents of his basket, the selected products, the quantities, the total price, delivery costs as well as his personal information.

The Customer is responsible for the accuracy of the information provided when ordering, including:

• his first and last name;
• his delivery address;
• his email address;
• his phone number;
• the chosen relay point, if applicable.

AZ Beautyk cannot be held responsible in the event of an error in the Customer's entry resulting in a delay, error or impossibility of delivery.

After validation of the order and payment, a confirmation email is sent to the Customer to the email address provided.

AZ Beautyk reserves the right to refuse or cancel any order in the event of:

• existing dispute with the Client;
• suspected fraud;
• incorrect or incomplete information;
• abnormal or abusive order;
• unavailability of a product;
• unable to execute command.

Article 7 - Payment

Payment is due immediately at the time of ordering.

The payment methods accepted are those offered on the Site at the time of validation of the order.

Transactions are secured by the payment providers used on the Site.

AZ Beautyk does not have access to the Customer's complete banking details.

The order will only be considered final after effective validation of payment.

In the event of payment refusal, the order will be automatically canceled.

Article 8 - Reservation of title

The products remain the property of AZ Beautyk until full payment of the price by the Customer.

However, the risks of loss or deterioration are transferred to the Customer at the time when the latter, or a third party designated by him, takes physical possession of the products.

Article 9 - Preparation of orders

Orders are generally prepared within a time frame of 1 to 5 working days, excluding weekends, public holidays, periods of high activity or exceptional circumstances.

Some orders may require additional time, particularly when items need to be ordered from suppliers.

During periods of high activity, collection launch, promotion or supplier restocking, preparation times may be extended.

AZ Beautyk undertakes to inform the Customer in the event of a significant delay or exceptional unavailability.

Article 10 - Delivery

Orders are shipped to the address indicated by the Customer when ordering or to the selected relay point.

AZ Beautyk works in particular with the following carriers:

• GLS;
• Mondial Relay;
• Colissimo.

The available delivery methods, prices and estimated times are indicated before validation of the order.

Delivery times are given for information purposes only. No delivery can be guaranteed for a specific date, unless expressly agreed in writing by AZ Beautyk.

Unless otherwise indicated, delivery takes place within a maximum period of 30 days from validation of the order.

In the event of late delivery, the Customer is invited to contact AZ Beautyk at the following address: azb.sav@gmail.com, so that verification can be carried out with the carrier.

Article 11 - Uncollected package, incorrect address or carrier return

In case of package returned to AZ Beautyk for any of the following reasons:

• incomplete or incorrect address;
• absence of the Client;
• package not collected from relay point on time;
• refusal of the package by the Customer;
• impossibility of delivery attributable to the information provided by the Customer,

AZ Beautyk will contact Customer to arrange a new shipment or refund.

The costs linked to a new shipment may be the responsibility of the Customer.

In the event of a refund, the initial delivery costs and any return costs invoiced by the carrier may be deducted, unless there is an error attributable to AZ Beautyk.

Article 12 - Receipt of the order

The Customer is invited to check the condition of the package and products upon receipt.

In the event of a damaged, opened, crushed or abnormal package, the Customer must, as far as possible:

• issue reservations with the carrier;
• take photographs of the package and products;
• contact AZ Beautyk promptly at: azb.sav@gmail.com.

Any complaint must be accompanied by the order number and the elements allowing the problem to be noted.

Article 13 - Right of withdrawal

In accordance with the Consumer Code, the Consumer Customer in principle has a period of 14 days from receipt of your order to exercise your right of withdrawal, without having to provide a reason.

To exercise this right, the Customer must contact AZ Beautyk at the following address: azb.sav@gmail.com, indicating:

• his first and last name;
• his order number;
• affected products;
• his clear desire to retract.

Products must be returned in their original condition, complete, unused, undamaged and, where possible, in their original packaging.

For reasons of hygiene and health protection, unsealed, opened, used or tried products after delivery cannot be returned when they can no longer be marketed for health or hygiene reasons.

This may in particular concern cosmetic products, care products, beauty accessories, hair products, products coming into contact with the skin, hair or mucous membranes, as well as any sealed product unsealed after receipt.

Return costs are the responsibility of the Customer, unless there is an error attributable to AZ Beautyk or a product recognized as defective.

The refund will be made after receipt and verification of the returned products, via the payment method used when ordering, unless otherwise agreed.

AZ Beautyk may defer reimbursement until receipt of the returned products or until the Customer provides proof of shipment of the products.

Article 14 - Returns, exchanges and refunds

No returns will be accepted without prior request to AZ Beautyk.

The request must specify:

• the order number;
• the product(s) concerned;
• the reason for the request;
• photographs in the event of a damaged, defective product or preparation error.

Products returned incomplete, used, opened, damaged, soiled or not allowing their return to sale may be refused.

In the event of a preparation error or defective product noted, AZ Beautyk will offer, depending on the situation:

• a replacement;
• an exchange;
• a credit;
• a refund.

Article 15 - Legal guarantees

The products sold by AZ Beautyk benefit from applicable legal guarantees, in particular:

• the legal guarantee of conformity;
• guarantee against hidden defects.

In the event of a non-compliant, defective product or one presenting a hidden defect, the Customer is invited to contact AZ Beautyk at the following address: azb.sav@gmail.com.

The Customer must provide any useful element in processing his request, in particular:

• the order number;
• a precise description of the problem;
• photographs of the product concerned;
• any information to identify the defect.

These guarantees apply regardless of the right of withdrawal.

Article 16 - Use of products and precautions

The Customer is required to respect the advice for use, precautions for use, deadlines, instructions, compositions and contraindications appearing on the product sheets, packaging or supplier instructions.

AZ Beautyk cannot be held responsible in the event of misuse of the product, use not in accordance with its intended purpose or non-compliance with the precautions for use.

In the event of an allergy, sensitive skin, pregnancy, medical treatment, particular pathology or doubt about the use of a product, the Customer is invited to seek advice from a competent professional before use.

The appearance of an individual reaction, in particular allergic or skin, cannot automatically engage the liability of AZ Beautyk, unless there is a proven defect in the product or an applicable legal breach.

Article 17 - Responsibility

AZ Beautyk cannot be held responsible for any resulting damage:

• from misuse of products;
• failure to follow precautions for use;
• an error or omission in the information provided by the Customer;
• a delay attributable to the carrier, unless otherwise provided by law;
• of an unforeseeable event beyond his control;
• force majeure.

AZ Beautyk can only be held liable under the conditions provided for by law.

Article 18 - Force majeure

AZ Beautyk cannot be held responsible for any delay or inability to perform its obligations in the event of force majeure or an event beyond its control.

Are considered in particular as cases of force majeure:

• strikes;
• natural disasters;
• fires;
• floods;
• epidemics;
• administrative restrictions;
• significant transportation disruptions;
• exceptional supplier break;
• major technical failure;
• any unpredictable, irresistible and external event.

Article 19 - Personal data

The personal data collected when ordering is necessary for processing, payment, delivery, order tracking and customer relationship management.

AZ Beautyk undertakes to process the Customer's personal data in accordance with the applicable regulations regarding the protection of personal data.

The Customer has in particular a right of access, rectification, opposition, erasure and limitation of the processing of his personal data.

Article 20 - Intellectual property

All elements present on the Site https://azbeautyk.com/, in particular, texts, photographs, images, logos, graphics, videos, brands, trade names and content, are protected by intellectual property law.

Any reproduction, representation, modification, distribution or use, total or partial, without prior written permission from AZ Beautyk is strictly prohibited.

Article 21 - Customer reviews

AZ Beautyk may allow Customers to post reviews about products or their purchasing experience.

The Customer undertakes to publish sincere, respectful and legally compliant reviews.

AZ Beautyk reserves the right to delete any review containing offensive, defamatory, discriminatory, misleading, advertising or contrary to applicable regulations.

Article 23 - Consumer mediation

In the event of a dispute, the Customer is invited to contact AZ Beautyk as a priority in order to seek an amicable solution.

In accordance with the Consumer Code, the Consumer Customer may have free recourse to a consumer mediator, after having sent a prior written complaint to AZ Beautyk.

Article 24 - Applicable law

These General Terms and Conditions are subject to French law.

In the event of a dispute, an amicable solution will be sought as a priority.

Article 25 - Modification of the General Terms and Conditions

AZ Beautyk reserves the right to modify these General Terms and Conditions at any time.

The applicable General Terms and Conditions are those in force at the time of validation of the order by the Customer.

Article 26 - Partial nullity

If a clause of these General Terms and Conditions were to be declared void, illegal or inapplicable, the other clauses would retain all their force and scope.
